Family-Based Immigration



Family-based immigration has two groups of immigrant visas: visas for immediate relatives and visas based on family preference categories. These visas are provided under the provisions of United States immigration law, specifically the Immigration and Nationality Act (INA).

Family-based immigration visas are divided into two different categories: Immediate Relative visas and Family Preference Visas.


Immediate Relative Immigrant Visas are for the closest relatives of US citizens. These may include a spouse, unmarried children under the age of 21 of a United States citizen, a child adopted abroad by an American citizen, a child to be adopted by an American citizen, or a parent of a U.S. citizen who is at least 21 years old.


Family Preference Immigrant Visas, however, are those that family members might obtain for their relatives but which there are a limited amount of visas available and a backlog has formed. Examples of this visas are those where a U.S Citizen files for his/her son or daughter who is over 21 and their family, U.S citizens filing for their siblings or U.S legal Permanent residents filing for their unmarried sons or daughters or spouse.
