Temporary Protected Status Venezuela



A new designation that allows Venezuelans to apply for TPS and Employment Authorization has been announced on March 2021. The Temporary Protected Status designated for individuals with origin from Venezuela has a registration period starting March 9, 2021 ending on September 5, 2021. The TPS Venezuela will provide temporary protected status through September 9, 2022 to those individuals who successfully obtain it. As recent as March 8, 2021, the new Secretary of Homeland Security under the Biden Administration, Alejandro N. Mayorkas, announced the designation to apply to Venezuelan nationals. The Temporary Protected Status for individuals without nationality who last resided in Venezuela (TPS Venezuela) allows those same individuals to apply for the protected status if they meet the eligibility requirements. The TPS program was created by the United States Congress in 1990 under the Immigration Act of 1990. It is provided to nationals of selected countries who are facing problems that make it hard or may face security risk if deported there. Countries may be designated for Temporary Protected Status for different reasons such as environmental disasters, armed conflicts destabilizing the region or other extraordinary conditions.  Since the Secretary of Homeland Security was given the discretion of designating countries to qualify for TPS, Secretary Mayorkas is well within the law to decide that Venezuela merits TPS designation. Under the Act, the designation could be made for 6, 12 or 18 months at a time and can be extended by the Secretary at least 60 days before expiration. In this case, the Secretary designated a period of 18 months of protected status to eligible Venezuelan nationals currently in the United States. According to the Secretary (per the official White House page at www.whitehouse.gov) “The living conditions in Venezuela reveal a country in turmoil, unable to protect its own citizens,” he continued to say “It is in times of extraordinary and temporary circumstances like these that the United States steps forward to support eligible Venezuelan nationals already present here, while their home country seeks to right itself out of the current crises.” It is mainly for this reason that the decision was made and now is the time for Venezuelans to take advantage of this opportunity to obtain Protected Status in the United States.

-       Be a Venezuelan national

-       Be continuously physically present in the US since March 9, 2021

-       Have continuously resided in the U.S. since March 8, 2021

-       Not be barred from asylum

-       Not be convicted of certain crimes


Once individuals with Venezuelan nationality are granted the TPS Venezuela, they will receive a temporary stay of deportation as well as authorization of temporary nature to work in the United States (via a separate application for Employment Authorization Documents or EADs) The beneficiaries would also be eligible to obtain permission to travel out of the country and return to the U.S. even though this benefit must also be applied for separately.
