E-2 Visa for Colombian Investors

The E-2 Visa or Treaty Investor Visa provides a tremendous opportunity to investors who desire to come to the United States to open a business with a significant or substantial investment.  This non immigrant classification permits nationals with country of origin which maintain a treaty of commerce and navigation with the USA or with which the USA maintains a qualifying international agreement to be admitted when a substantial amount of capital will be invested in a business that will be registered in the United States. 


According to the USCIS, a substantial amount of capital is:


  • Significant when compared to the overall cost of either purchasing an existing business or starting one from scratch.


  • Enough to secure the treaty investor's financial commitment to the enterprise's successful operation.


  • Of sufficient magnitude to ensure that the treaty investor will be able to successfully develop and direct the business.  To be called substantial, the investment must be proportionately higher than the enterprise's cost.

Colombian Nationals qualify for E-1 and E-2 Visas and have been designated as such since June 10, 1948. 


How Colombian Citizens can Apply for an E-2 Visa or Treaty Investor Visa Visa



It is crucial to highlight that a new policy has been adopted by the US Embassy in Colombia’s capital of Bogota regarding the application of E-2 visas. Therefore, the availability to candidates who do not live in Colombia of E-2 visa interview slots is highly limited. For at least one year before the application for E-2 visas, residents must be able to demonstrate their physical and legal presence in Colombia.


A certification of migration, given by the administrative body of Migración Colombia, is required to prove the applicant’s physical and legal presence in Colombia. 


To make an appointment, the Colombian National must first fill out Form DS-160, Nonimmigrant Electronic Visa Application.  After submitting this form, the applicant must save and print the confirmation page, which contains a 10-digit barcode number. The next step is to go to https://ais.usvisa-info.com/es-co/niv/ and pay the corresponding fee. Once the money has been received, the applicant will receive instructions via email on how to book the interview appointment. Once the appointment has been booked, we would proceed to submit your application at least 14 days prior to the interview date.


E-2 Visa Application Documentation


Citizens of Colombia desiring to take advantage of the E-2 Investor Visa benefits and who wish to apply must be able to provide the following (not limited to) documentation which will be packaged by our immigration attorney.

4.     Passport Style Color Photograph

7.     Evidence of employment in executive capacity

8.     Bank Records

9.     Financial Statements

10.  Demonstration / Evidence of Remittance to US

11.  Demonstration / Evidence of establishment of business

12.  Evidence that enterprise is not marginal

13.  Demonstration / Evidence of Nationality

14.  Demonstration / Evidence of Investment

15.  Demonstration / Evidence of Substantiality


Once granted, the E2 Visa will have a 5 year validity with available status extensions of up to 2 years at a time. There are no limits identified to the number of extensions the applicant may request.
